General Terms and Conditions
1. Scope of Application
These Terms and Conditions apply to all orders placed through our online shop by consumers and businesses.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, craft or profession. A business is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business, craft or profession.
For businesses: We hereby object to any conflicting or supplementary general terms and conditions ofthe business; they shall only become part of the contract if we have expressly agreed to them.
2. Contracting Party, Conclusion of Contract
The purchase contract is concluded with 3Scoutz GmbH.
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalogue. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained in the order process. By clicking the order button, you submit a binding offer for the goods contained in the shopping cart. Confirmation of receipt of your order will be sent by email immediately after the order has been submitted.
When the contract is concluded with us depends on the payment method you have selected:
In any case, acceptance shall occur no later than upon dispatch of the goods or a separate declaration of acceptance (order confirmation) by email.
3. Contract Language, Storage of Contract Text
The language available for concluding the contract is German.
We store the contract text and send you the order data and our Terms and Conditions by email. You can view the contract text in our customer login.
4. Delivery Conditions
In addition to the stated product prices, shipping costs will apply. Further details on the amount of shipping costs can be found with the offers.
We only deliver by mail order. Unfortunately, collection of goods in person is not possible.
We only deliver to Germany.2
5. Payment
In our shop, the payment methods offered by Shopify Payments are generally available to you. These
may include:
Credit Card: When placing the order, you provide your credit card details. After your legitimation
as the rightful cardholder, we will instruct your credit card company to initiate the payment transaction immediately after the order is placed. The payment transaction is carried out automatically by the credit card company and your card is debited.
PayPal: During the order process, you will be redirected to the website of the online provider PayPal. To pay the invoice amount via PayPal, you must be registered there or register first, authenticate yourself with your access data and confirm the payment instruction to us. After placing the order in the shop, we will instruct PayPal to initiate the payment transaction.
Klarna: Additional payment methods (e.g. purchase on account, installment purchase, pay immediately) may be processed via the payment service provider Klarna. Klarna’s terms and conditions apply to these.
Apple Pay / Google Pay / Shop Pay: If you pay via one of these wallets, processing is carried out by the respective provider under their terms and conditions.
6. Retention of Title
The goods remain our property until payment has been made in full.
For businesses, the following also applies: We reserve the right to retain title to the goods until all claims arising from an ongoing business relationship have been settled in full.
7. Transport Damage
If goods are delivered with obvious transport damage, please complain about such defects to the carrier as soon as possible and contact us immediately. Failure to submit a complaint or contact us has no consequences whatsoever for your statutory claims and their enforcement, in particular your warranty rights. However, you help us to be able to assert our own claims against the freight carrier or transport insurance.
8. Warranty and Guarantees
Unless expressly agreed otherwise below, statutory liability for defects applies.

9. Liability
We are always liable without limitation for claims due to damage caused by us, our legal representatives or vicarious agents
- in the event of injury to life, body or health,
- in the event of intentional or grossly negligent breach of duty,3
- in the event of guarantees, insofar as agreed, or
- insofar as the scope of application of the Product Liability Act (Produkthaftungsgesetz) is opened.
In the event of a breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and on the compliance with which the contracting party may regularly rely (cardinal obligations), through slight negligence by us, our legal representatives or vicarious agents, liability is limited in amount to the damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.
10. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR), which you can find here: https://ec.europa.eu/consumers/odr/ (https://ec.europa.eu/consumers/odr/).
We are not obliged and not willing to participate in a dispute resolution procedure before a consumer arbitration board.
11. Final Provisions
If you are a business, German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
If you are a merchant within the meaning of the German Commercial Code (Handelsgesetzbuch), a legal entity under public law or a special fund under public law, our place of business is the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you.
